All claims allowed at first instance in a housing-association trust collection case

The client’s problem

The clients had obtained a final judgment ordering the return of their contributions because their local housing-association membership agreements were invalid. The project funds were held in an account in the trustee’s name, and disbursement required a request by the organising committee and consents from the construction company and project service company under the fund-management agreement.

Our work

Attorney Kim Hyun-jung represented the clients in seeking both an order requiring the organising committee to express its request for disbursement and payment by the trustee under the collection orders. Relying on the final refund judgment and the attachment and collection orders, she argued that the committee had a duty to cooperate in disbursement. The finality of a separate court decision recommending settlement concerning the construction and project service companies’ consents was considered alongside the fund-management agreement in challenging the trustee’s position that the request and consents had to be contained in a single document.

The confirmed outcome

The court allowed all claims and ordered the defendants to bear the litigation costs. It ordered the organising committee to express its request for disbursement and the trustee to pay the judgment principal and interest upon receiving that request and the consents of the construction and project service companies, within the balance of the managed account. In these circumstances, the court also found no basis to require additional refund-confirmation documents such as a separate termination request. This is a first-instance result. Whether this judgment has become final and whether payment has actually been made require separate confirmation.
